As the Nottingham Selective Licensing Scheme gets underway NGalloway can report that Nottingham City Council will risk assess properties that have an EPC rating of F or G to require an inspection as part of the licensing process.
With case law meaning that the scheme cannot require people to upgrade their properties so the only option open for the council to make landlords improve conditions is to assess using the HHSRS. Properties that are at F and G are easy pickings for the council because there is a high likelihood of these properties having an excess cold risk under HHSRS.

From April 1st 2018 it became illegal to create a new tenancy in properties that had a rating below E. For existing tenancies the new rules will kick in on 1st April 2020.
What is important to note is that landlords maybe putting themselves in danger of inspection when they have already carried out improvements but not updated the EPC.
